Co-operative form 72 - Application for voluntary deregistration of a co-operative

This form is used to apply for voluntary deregistration of a co-operative under the Co-operatives Act 2009 (the Act) provided it meets certain criteria. Once deregistered, the co-operative ceases to exist as a legal entity and can no longer do anything in its own right.

Before applying co-operatives need to ensure that they meet the following requirements:

  • All members have agreed to its deregistration.
  • The co-operative is not conducting business.
  • The co-operative’s assets are worth less than $1,000.
  • The co-operative has paid all fees and penalties payable under the Act.
  • The co-operative has no outstanding liabilities (e.g. unpaid employee entitlements or taxation liabilities).
  • The co-operative is not involved in any legal proceedings.

Applications that do not meet these requirements (including lodgement of due annual returns) and are not signed by the co-operatives director or secretary will be rejected.

What do I need to complete an application

To complete the submission of this form you must:

  • Complete all the relevant sections of the form.
  • Sign the declaration.
  • Attach documentation supporting that all members of the co-operative agree to its deregistration.
  • Pay the application fee.

Attach a cheque or money order made out to "Department of Energy, Mines, Industry Regulation and Safety" to the completed form.
