Scott has practiced as an adjudicator since the introduction of the Construction Contracts Act (WA) and is one of WA most experienced adjudicators. He has conducted many adjudications under the Act, with sums in dispute ranging from about $100,000 to about $50 million. He is also an adjudicator under the Construction Contracts (Security of Payments) Act 2004 (Northern Territory).

Phil Faigen is a grade 1 arbitrator (1st graded 1990), accredited mediator (1999) and has been a member of the Town Planning Appeals Committee. For almost 20 years prior to entering the law, Christopher worked in construction of commercial projects for some of Australia’s larger contractor, and later design and construction project management of hotels and resorts both within Australia and South East Asia. During that time, he developed an expertise in addressing distressed projects, often called upon to reorganise projects and bring them back on track. In such roles he was substantially involved in dispute management and resolution at the coal-face, such involving delays, prolongation, defective work, variations, and cost overruns.

Max is a Chartered Professional Engineer with more than 45 years experience in building and engineering projects, including 25 years in contract development, contract administration and dispute resolution.
From 2001 until 2005 Max was General Manager, Procurement Systems in the NSW Department of Commerce (formerly Department of Public Works and Services, now Department of Finance, Services and Innovation). Stuart is a civil engineer with a professional career spanning over 40 years in the building and construction industry.
His career initially focused on engineering design, documentation and construction management. He then specialised in commercial dispute resolution for construction and goods & services procurement for the NSW Government, including in the application of mediation, expert determination, arbitration and litigation. He progressed to become responsible for the NSW Government’s Procurement System for Construction used for the procurement of some $1.0Bn of government infrastructure annually, developing new contracts and contract management systems, and providing advice to government on procurement policy, legislation and practice [including the Building and Construction Industry Security of Payment Act 1999 (NSW)].
