Paid family and domestic violence leave entitlement now in effect

A new entitlement for 10 days’ paid family and domestic violence leave (FDV leave) has commenced for all employees in the state industrial relations system.

This entitlement, which commences today, 9 September 2024, comes from the National Employment Standards in the federal Fair Work Act 2009.

Under the national provisions, a full time, part time or casual employee is able to take paid FDV leave if:

  • the employee is experiencing family and domestic violence; and
  • the employee needs to do something to deal with the impact of the family and domestic violence; and
  • it is impractical for the employee to do that thing outside the employee’s ordinary hours of work.

The paid FDV leave entitlement is in addition to the minimum five days’ unpaid FDV leave already available to all employees in the state industrial relations system under the Minimum Conditions of Employment Act 1993.
